Common Types of Talent Visas
These are some of the most prominent examples of global talent visas we help clients obtain:
EB-1 Visa
The EB-1 visa is designed for individuals with extraordinary abilities, outstanding professors or researchers, and certain multinational executives or managers. Applicants for this employment-based visa must demonstrate exceptional achievements in their particular field. Evidence may include national or international awards, published work, or leadership in distinguished organizations.
EB-2 NIW
The EB-2 National Interest Waiver (NIW) provides a pathway for foreign nationals with advanced degrees or exceptional abilities to bypass the standard job offer and labor certification requirements if their work substantially benefits the United States. Applicants must submit evidence of their expertise and how their proposed endeavor serves the nation’s interests. Examples include scientific research or public health advancements.
O-1 Visa
The O-1 visa is a temporary visa for individuals with extraordinary abilities. Eligible individuals must provide evidence of sustained national or international acclaim, such as awards or outstanding achievements. Applications require sponsorship by a U.S. employer or agent. The O-1 visa is valid for up to three years and is renewable indefinitely.
Applicants cannot self-petition. However, a separate legal entity owned by them--such as a corporation or LLC, can file a petition on their behalf, subject to exceptions. Furthermore, letters from U.S. government agencies or quasi-governmental entities detailing the significance of the applicant’s contributions can establish their extraordinary ability.
Immigration authorities interpret “field” and “area of extraordinary ability” broadly, meaning that O-1 visa holders who switch fields can still meet requirements, so long as the new field is at least related to the original.
P-1 Visa
The P-1 visa caters to athletes, artists, and entertainers. For athletes, eligibility includes a significant level of achievement, such as internationally recognized performance. U.S. employers or agents must file petitions for an applicant to obtain this visa.
TN Visa
The TN visa allows professionals from Canada and Mexico to work in the U.S. under the United States-Mexico-Canada Agreement (USMCA). Eligible occupations include roles in sciences, engineering, education, and healthcare, among others. Applicants must meet specific educational and professional requirements, such as a bachelor’s degree or relevant certifications.
The application process involves presenting credentials at the border or through the United States Citizenship and Immigration Services (USCIS) if already in the U.S. TN visas are valid for up to 3 years and are renewable indefinitely as long as the applicant continues to meet the eligibility requirements.
